Abstract

The report analyses the decision of the court to declare insolvency for the debtor. The insolvency proceedings are opened against insolvent trader, who is solvent or over-indebted. The effect of adjudication is to declare insolvency. This court decision is constitutive and has a notification action. The decision has an immediate enforcement and may be appealed within 7 days from the date of entry into the Commercial Register. Appeals do not have a suspensive effect.
