Abstract

This report contains an analysis of the Pilot Judgment procedure of the European Court for Human Rights in application of article 46 of the European Convention on Human Rights. The first part of the report analyses the new Rule 61 of the Rules of Court, which codifies the Pilot Judgment procedure. The second part of the report includes an analysis of the first two pilot judgments against Bulgaria. The ECHR recommends Bulgaria to introduce suitable legal mechanisms to solve a systemic problem in existing justice system – the absence of effective legal remedies for excessive length of civil, administrative and criminal proceedings.
