Abstract

The institution of asylum originated in Antiquity. In our time, it is an institution of International Law, but also one of the human rights. This institution represents the legal opportunity for a State to accept in its territory and provide protection to a foreigner persecuted for political reasons in another State. In International Law, the generally recognized type of asylum is territorial one; therefore it has a universal character. But in addition to this type of asylum, there is another type, although recognized only by the States of the Latin American region - diplomatic asylum. Therefore, it has a regional character, which in turn predetermines the specificity of the legal regulation of this asylum. This specificity explains the scientific interest in clarifying the institution of diplomatic asylum in International Law.
