| dc.description | The stability and security of commercial transactions is of primary importance in commercial relations. The Commercial Law contains provisions governing the particularities of commercial transactions, which are dictated by the ideas of speed, simplicity and security in commercial turnover. The subject of this report is the question regarding the form of reality of commercial transactions. The form provided for in the provision of Art. 293, para. 1 of the Commercial Law is about the validity of commercial transactions. The aim is to analyze the special hypotheses established in the Commercial Law regarding the form of commercial transactions and the specific consequences that find expression in the practice of the Supreme Court of Cassation. | |
| dc.description.abstract | Основно значение при търговските отношения е стабилността и сигурността на търговските сделки. Търговският закон съдържа разпоредби, уреждащи особеностите на търговските сделки, които са продиктувани от идеите за бързина, опростеност и сигурност в търговския оборот. Обект на настоящият доклад е въпросът относно формата за действителност на търговските сделки. Формата предвидена в разпоредбата на чл. 293, ал. 1 от Търговския закон е за действителност на търговските сделки. Целта е да се направи анализ на особените хипотези установени в Търговския закон по отношение формата на търговските сделки и специфичните последствия, които намират израз в практика на Върховния касационен съд. | |
