dc.descriptionThe article aims to lay the foundations for the theoretical analysis of the release from criminal liability. Consideration of the specific conditions for its application is pointless if it is not clear what distinguishes this institution from other criminal law institutes, which exclude on one basis or another the application of criminal repression. The issue is all the more significant given that certain ambiguities and inconsistencies in the terminology used lead to confusion in both doctrine and practice.
dc.description.abstractСтатията има за задача да постави основите при теоретичния анализ на освобождаването от наказателна отговорност. Разглеждането на конкретните условия за прилагането му е безпредметно, ако няма яснота какво отличава този институт от другите наказателноправни институти, които изключват на едно или друго основание прилагането на наказателната репресия. Въпросът е толкова по-значим, като се има предвид, че определени неясноти и непоследователност в използваната терминология водят до объркване както в доктрината, така и в практиката.
