Abstract

The principle of forum prorogatum (postponed jurisdiction) is applied in the jurisprudence of the UN International Court of Justice for the purpose of grounding its jurisdiction in a legal dispute where it has not any other justification. The basis of the jurisdiction of the Court in case of forum prorogatum is the application by one of the States parties to the dispute, and the consent, tacit or explicit, by the other party, that the Court decides the dispute.
