Abstract

The scientific paper researches the legal aspects of the financial derivatives and the deals with derivatives. Using this kind of prism, some concepts for the derivatives, the first legal definitions for the types of derivatives, margin purchases and the short “naked” sales are pointed out. Some processes for harmonization of the legal statute of derivatives with the European legal norms are analysed. As a structure the scientific theses contain an introductory part, chapter one - some legal aspects of the financial derivatives, part two covers the harmonization of the legal statute of derivatives with the European legal norms and the concluding part offers the conclusions that have been reached.
