| Abstract: | Статията разглежда въпроси относно действието на колективния трудов
договор във времето. Засяга въпроси, решавани противоречиво в съдебната практи
ка относно действието на изменение на колективен трудов договор, което влиза в
сила преди момента на сключването му. Обсъдени са предпоставките, които тряб
ва да са налице, за да може изменението да регулира трудови правоотношения. За
сегнати са въпроси относно действието на изменение на колективен трудов дого
вор, което влиза в сила преди момента на сключването му и предвижда по-неблаго
приятни условия за работниците и служителите, за които се прилага, от вече дого
ворените. |
| Description: | The article examines issues regarding the effect of the collective labor agreement
over time. It addresses issues resolved inconsistently in case law regarding the effect of an
amendment to a collective labor agreement that enters into force before the moment of its
conclusion. Discusses the preconditions that must be present in order for an amendment to
regulate employment relations. Issues are raised concerning the effect of an amendment to
a collective agreement which enters into force before the time of its conclusion and
provides for less favourable conditions for the employees to whom it applies than those
already agreed. |
