Abstract

Настоящая статия предлагает сравнительно-правовое исследование института главы государства в системе единство государственной власти и разделение ее ветвей. Расматриваются юридический статус главы государства и его фактическое положение, место в системе разделение властей, полномочия и его ответственность. Исходная позиция анализа представляет теория Б.Констана об „нейтральной власти” монарха. Тhis Article examines the power of the Head of the State and the constraints on monarch`s power even in the absence of more robust structural constraints. The Constan`s theory of „pouvoir neutre” is the solution for constitutional grounds to make governing possible. Constitutional responsibility of the Head of the State is a consistent textual theme found in the virtues of his „pouvoir neutre” and a part of the obligation to preserve the integrity of the government itself.
